The USPS would like to assist enterprises that mail CBD and hemp vaporizers prepare for an upcoming law amendment that could affect their products’ mailability.
According to a notice featured in yesterday’s Federal Register, the department talked about how a congressional reform passed in 2020 will inhibit the companies’ capacity to use USPS’s services when mailing vapes. However, regarding the output of rulemaking, there could be exceptions for specific device types.
The Postal Service disclosed that it’s still concluding its regulation and contemplating whether to expand the exemption to particular vaping items, such as those containing legal hemp-based CBD. However, since the mailing prohibition will be implemented immediately after the rules are concluded, the department is offering prior guidance about how to submit an exemption application in case it decides to provide one.
USPS further restated in the recent note that mailing cannabis commodities is still illegal since cannabis remains a state-regulated substance liable to its statutory restrictions.
Federal Register notice doesn’t mention any restrictions regarding marijuana vape gadgets that lack regulated substances. However, industry participants have raised concerns regarding a congressional law’s language that expands the mailing prohibition to any electronic gadget that delivers flavor, nicotine, or any substance to the user.
The reform forces vape retailers and manufacturers to use more costly courier services by preventing them from utilizing the Postal Service to transport their items.
In the case of CBD and Hemp products’ exemptions, the conventional application procedure entails submitting paperwork indicating that a specific mailer is operating legally. The USPS also pointed out that a different spreadsheet should be included indicating whether commodities contain THC or CBD.
For THC products, the concentration and quantity should be written down. For CBD commodities containing over 0.3% THC, the enterprise should note whether the cannabidiol was extracted from hemp.
