A Tennessee beverage company that produces CBD beverages is being sued by a Denver company that sells CBD sports drinks. The company is alleging that its competitor is selling products that are nearly identical to their brand.
In the lawsuit that was filed on June 26, Defy LLC brought the case to Colorado federal court. The suit against defiance brands is about a line of sports drinks entitled Defy Limitation(s).
The Denver company, Defy, sells a line called Defy and “Defy for the active lifestyle”.
“Through its significant investment, Defy has earned substantial goodwill and consumer recognition in the DEFY Marks for use in connection with nutrient-enriched beverages and related products,” Defy’s attorneys state.
With the second product hitting the shelves years after Defy has been in business, the company took offense. The lawsuit looks to stop the company from using the Defy name in its products.
Terrell Davis, hall of fame Broncos running back, is an investor and spokesman for Defy.
